“Agreement” – Deloitte MCS contract with the Organisation(s) incorporating the licence agreement, costs and general terms and conditions of supply
“Applicant”- Any user registered with the Oriel Solution
“Content”- All text, images, documents and links contained within the Oriel Solution controlled and managed by the Organisation(s)
“Organisation(s)” - The Organisation(s) to whom the Oriel Solution is provided under the Agreement, this includes the contract owner Health Education England (HEE) and recruitment organisations authorised by HEE to be involved in recruitment such as the HEE local offices, Devolved Nations and Royal Colleges.
“Oriel Solution” - The online recruitment system provided to the Organisation(s) and the Applicant as a hosted and maintained software service via the Internet
“Suppliers” – The organisations who provide the Oriel solution, these include Hicom Ltd, UKCloud and Deloitte MCS Ltd
“Users” - Any authorised user registered with a log-on for the Oriel Solution

This statement sets out the terms and conditions for use of the Oriel solution, which forms part of an online recruitment service provided by the suppliers to the Organisation(s).Your access to, and use of, the Oriel solution, is subject exclusively to these Terms and Conditions and by proceeding and continuing to access the Oriel solution you agree to be legally bound by these Terms and Conditions.  The suppliers and the organisation(s) reserve the right to update or amend these Terms and Conditions at any time and your continued use of the Oriel Solution shall be deemed to be your acceptance of any such change.

When you access the Oriel solution, you are agreeing to do so only for your private use and not for commercial or public use; and to use this site only for lawful and proper purposes, in a manner that does not infringe the rights of, or restrict, inhibit the use and enjoyment of, this site by anyone. 

Such restriction or inhibition includes, without limitation, conduct:
• which is unlawful
• which may harass
• which may cause distress or inconvenience to any person
• involving transmission of obscene or offensive content
• which disrupts normal working of this site

You will not use the Oriel solution for any purpose that is unlawful or prohibited by these Terms and Conditions or by the laws of the United Kingdom (one example of which is the computer misuse act) or any country from which the Oriel solution is accessed. 

Specifically in using the Oriel solution you agree that:
• You will not post or publish any information or materials that are considered defamatory, obscene, indecent, threatening, abusive or unlawful in any way.
• You will not violate any applicable laws or regulations, including impersonating any person or entity for the purpose of misleading others.
• You will not upload or make available in any way files that contain a virus or other such corrupt data that may damage or impede the operation of the Oriel solution OR the property of others.
• You will not use the Oriel solution in any manner that could damage, disable, overburden or impair the Oriel solution or interfere with any other party’s use of the Oriel solution.
• You will not attempt to gain unauthorised access to any part of the Oriel solution, any other accounts, systems or networks through the process of hacking or by any other means.

The Suppliers and the organisation(s) accept no liability for the misuse of the Oriel solution by any party.  The Suppliers and the organisation(s) accept no liability for any consequences related to any person's misuse or inability to use the Oriel solution.  The suppliers and the organisation(s) do not guarantee uninterrupted access to the Oriel Solution.

On registration to this site you will be granted secure access to the Oriel solution via log-in credentials (email address and password).You are responsible for maintaining the confidentiality of your log-in credentials and for all activities which take place under your account.  You agree to immediately notify the suppliers of any unauthorised use of your log-in credentials or any other breach of security, whether proven or suspected.  In no event will the suppliers be liable for any direct, indirect or consequential loss or damage whatsoever resulting from the disclosure of your log-in credentials. You may not use another person’s log-in credentials at any time.

The Intellectual Property Rights (IPR), copyright and ownership of the Oriel solution as a whole or in part shall remain vested with the suppliers at all times.  All text, images and data provided by the suppliers as part of the Oriel solution are subject to copyright but may be downloaded and printed only by the recruitment organisations and/or the Applicants for personal use only to assist with the recruitment process and must not be used for commercial gain or other exploitation.  Logos, names and images identifying the recruiting organisations are the proprietary marks of HEE and its stakeholders. You are prohibited by law to reproduce them.  No party, including NHS Organisations and/or Applicants may otherwise use, copy or save text, images or data, or distribute any material from the suppliers.  The suppliers decision in relation to any requests for use or publication of text, images or data from the Oriel solution is final and made at the suppliers absolute discretion.  In using the Oriel solution you agree that you will not post or publish material or information that you do not have a right to do so under any law or under any existing contractual agreement including, but not limited to, any material that may infringe an existing copyright.

The suppliers will attempt to ensure that all information presented within the Oriel solution is accurate, however no guarantees are given in respect of its accuracy, completeness or adequacy.  The suppliers make no guarantees that the Content will meet your requirements or that the Content is accurate, reliable or error free. Any comment or concern in respect of the Content should be addressed to the Organisation(s).  The Oriel solution may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and the suppliers are not responsible for the content or availability of any such sites.  The suppliers make no guarantees or hold any control over whether Applicants meet the requirements set by NHS Organisations or are subsequently offered employment.

Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site.  When you access the Oriel solution, your computer's browser provides us with information such as your IP address, browser type, access time and referring URL which is collected and used to compile statistical data on the use of our system. This information may be used to help us to improve our system and the services we offer.  We do not use cookies on our system other than in the online application section where session cookies are used. These are required to enable that section of the site to be used and navigated. A session cookie is stored temporarily by your computer. Session cookies can be disabled by changing the settings on your browser, but you will not be able to access the application form section of our system if you do so. Demographics - Our server records your visit for demographic reasons and to help us understand how you use the Oriel solution. We use the information we collect to improve the Oriel solution and provide better services. The information we collect is treated in accordance with the Data Protection principles outlined in the Data Protection Act 1998 and the General Data Protection Regulation 2018.
